VILLAGE BOARD of TRUSTEES
SPECIAL MEETING
August 31, 2005


The Special Meeting of the Board of Trustees was called to Order by Mayor Wayne Bailey at 7:00 p.m. with the following present:

Trustee Robert Bausch
Trustee Paul Cooper
Trustee Anna Marie Barclay
Trustee Virginia Adams

Also present were Village officials Deputy Clerk Linda Austin, Village Attorney Craig Welch, Esq., Planning Board Chairman Dale Leiter, DPW Supervisor Joseph Chimino, CEO/ZEO Thomas Williamson and Village Engineer Carl Schoenthal. Also in attendance were representatives of applicant: Robert Fitzgerald, Marcia Havens and Buddy Filowick.

Of the Revised DEIS

At its special meeting on August 31, 2005, the Village Board of Trustees stated the purpose for this meeting was to go thru the FEIS with all the engineers. The main issues are the drainage and sewer impact on the Village. The following questions were asked:

Wayne:

Why are you constructing the farthest pond area in phase II first?
Rob: The elevation would not allow the use of the pond #2 for the first
Phase. Phase 3 & 5 will go to the 2nd pond.
Carl:

He would need detail of the new drainage for phase 1 and a flow
quantity, phase by phase

Buddy: Stated he would probably start straight down Parkview first it
was the best way to start.
Wayne: What about the phase order in the DEIS?
Rob: The phases are just reference, they are not in the order of build.
Wayne: Can you calculate the drainage rate for the project to make sure
the drainage can be handled by the first pond in case of a 100 year
storm? How much it will take before the area would be flooded?
Carl: Said he could calculate the drainage for each phase. He would have to
look at each section.
Rob: Stated the pond construction would be totally completed before the
second phase would be done.
Wayne: One option stated was the use of septics. No septics are allowed
by home owners due to our Village Sewer code.
Rob: Stated he knew of this but put it in as an option if the code changed.
Wayne: Option A, proposed storm sewer for runoff from the infiltration
basin, how will this be built and who will be responsible for this?
Buddy: At a previous Village Board meeting the Village stated it would
supply them with a sewer outlet to Munger St.
Wayne: States the Munger St. project may not be done before Buddy
would need access to it.
Buddy: Stated that they maybe able to use Rochester St. instead of Munger.
He would be willing to construct the system to Rochester St.
Bob:

Concerned about the upkeep of the acreage during the construction
of the project, he would like the overgrowth kept down for the
neighbors.

Virginia: How do we accept the phasing if it changes down the line?
Craig:
Stated think the total build out, as long as the numbers works, who
Cares. Order of phasing should not be a concern for the FEIS.
If the phases are different. They could give us a map of each drainage area and pattern.
Bob: What will be the capacity of the sewer for the project?
Carl: It will be 24,000 per day when completed.
Wayne:
Every hook-up is a $1200.00 fee which could be used to upgrade the
sewer plant.
Rob: Stated, Buddy would be paying 78% of the money needed to upgrade
the sewer plant.
Paul: Asked about the sidewalks.
Wayne: Stated the sidewalks would go to the planning board to decide on.
Bob: Questioned the right of way for the Village to service the project.
Will the width of the driveway be large enough and easements will
be needed for the Village to gain right of way.
Craig: Stated we might need a drainage district. The Village would need
easements for pond access. It would be home owners responsibility
to keep the mowing of the pond basins.
Rob: Stated, the Village would be responsible for the road work permits
for the construction of the new intersection at Parkview and
Buffalo Rd.
Craig:

In order to proceed, the language of the DEIS needs to be fixed.
And need a swale clarification on phase 1-2-3. Also a list of
things to be corrected and clarified.

Bob: Stated, that Phase 1 would drain into the 2nd pond. Under phase 1
in the DEIS it states the runoff from these lots will be directed
through a proposed storm sewer to a proposed infiltration basin.
Buddy: Stated that the statement in the DEIS under Phase 1 was incorrect.

 

The motion was made by Trustee Robert Bausch and seconded by
Trustee Virginia Adams to adjourn. The motion carried by the
following vote:

Trustee Bob Bausch- aye
Trustee Paul Cooper- aye
Trustee Anna Marie Barclay- aye
Trustee Virginia Adams- aye

The meeting was adjourned at 8:23 p.m.
