VILLAGE BOARD of TRUSTEES
Regular Meeting Minutes
July 14, 2004


The Regular Meeting of the Board of Trustees was called to Order by Mayor Wayne Bailey at 7:00 p.m. with the following present:
Trustee Robert Bausch
Trustee Anna Marie Barclay
Trustee Virginia Adams
Trustee Paul Cooper

Also present were Administrator Tracy Jong, Elizabeth Smith, Dale Leiter, Tally Almquist, Paul List, Tom Williamson and DPW Supervisor Joe Chimino.


APPROVAL OF MINUTES
A motion to approve the minutes of the Regular Meeting of June 23, 2004 was made by Trustee Paul Cooper and seconded by Trustee Robert Bausch. The motion carried by the following vote:
Trustee Robert Bausch - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye
Trustee Anna Marie Barclay - abstain


APPROVAL OF BUDGET TRANSFER
A motion to approve a budget transfer of $902.00 from 1640.200G to 8122.200G was made by Trustee Robert Bausch and Trustee Anna Marie Barclay. The motion carried unanimously.


APPROVAL OF BILLS

A motion to approve the bills was made by Trustee Robert Bausch and seconded by Trustee Virginia Adams. The motion carried by the following vote:

Trustee Virginia Adams - aye
Trustee Paul Cooper - aye


PRIVILEGE OF THE FLOOR
Paul List discussed the request for a developer to purchase a
5-acre portion of the sewer plant land for the development of a senior assisted living facility. Basic details about the initiative were conveyed to the Board. The Board will consider the request and advise him soon.

Dale Leiter proposed a future second fire station on the south side of the railroad tracks, possibly at Appletree Acres. With the new subdivision and Empire Zone, it would be prudent for emergencies to have one station on each side of the railroad tracks.


TRUSTEE CONCERNS
Trustee Virginia Adams complained about residents not putting trash inside Village bags used, rather tying them to the garbage bins. She would prefer garbage not be picked up by Waste Management if not in a Village bag. We should be sure the bags were at least taken by Waste Management in those cases. She also requested new Village of Bergen signs. Joe was asked to research the cost of new signs.


DPW SUPERVISOR'S ORAL REPORT
A motion to approve the oral report of the DPW Supervisor was made by Trustee Virginia Adams and seconded by Trustee Robert Bausch. The motion carried by the following vote:

Trustee Robert Bausch - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye

Highlights include:

· Poles for K-2 Industries are nearly installed
· Roads will be done in August with mutual aid from Byron and Churchville. This was a tremendous cost savings
· Power outage at the north end of the Village of Bergen
· Easements are in place on Munger Street for upcoming electric work, remaining Haywood easement expected soon
· Electric bucket truck bids were opened this week
· 2 new lineman employees started and a new MEO will be starting next week
· Sidewalks and stump removal will be completed by end of July
· Manhole coating was completed


CEO REPORT
A motion to approve the oral CEO's report was made by Trustee Anna Marie Barclay and seconded by Trustee Virginia Adams. The motion carried by the following vote:
Trustee Robert Bausch - aye
Trustee Anna Marie Barclay - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye

Highlights included:

· Enforcement proceedings and final court results on several properties
· Call about a bonfire in the Village; proposed a local law concerning recreational fires and junk cars
· Property maintenance at CSX property at former Church Street crossing


ADMINISTRATOR/CLERK TREASURER'S REPORT
A motion to approve the written and oral Administrator's report was made by Trustee Robert Bausch and seconded by Trustee Virginia Adams. The motion carried by the following vote:

Trustee Anna Marie Barclay - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye


MAYOR'S REPORT

Highlights include:

· Meeting with Town Supervisor
· Meeting about Mayne development and drainage


HISTORIAN'S REPORT
A motion to approve the oral Historian's report was made by Trustee Anna Marie Barclay and seconded by Trustee Paul Cooper. The motion carried by the following vote:
Trustee Robert Bausch - aye
Trustee Anna Marie Barclay - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye

Highlights include:

· Completion of Bergen Swamp book
· She intends to sell it for $5.00 each


NEW BUSINESS

1.

Responding to her request for tree trimming, Trustee Robert Bausch made a motion for Barbara Maxwell, 18 Buffalo Street, to be given following option: move her fence and the Village will be responsible for tree, or sign a borderline agreement and she is responsible for maintaining the tree.

The motion was seconded by Trustee Paul Cooper and carried by unanimous vote.

2. Motion by Trustee Robert Bausch and seconded by Trustee Virginia Adams to award the bucket truck bid to DUECO, the low bidder for approximately $124,000. The Village will purchase the new truck as opposed to the demo vehicle. The motion carried by the following vote:

Trustee Virginia Adams - aye
Trustee Paul Cooper - aye
3. Proposed Local Law for Junk Vehicles - tabled.
4. Proposed Local Law for Patriot Act - tabled.
5. Proposed Local Law for Recreational Burning - tabled.


OLD BUSINESS

1.

Appointment of alternates to Planning and Zoning Board by Mayor Bailey:
Kevin Donovan - Planning Board
Chris Vurarro - Zoning Board of Appeals

2. The committee (Trustee Robert Bausch and Trustee Paul Cooper) on Local Law on Parking Restriction reported their findings. They will continue to work on this issue. Enforcement is the largest issue.
3. Revised Local Laws No. 9 & 10 concerning abatement for property maintenance and zoning violations were presented. Discussion was tabled.

 

EXECUTIVE SESSION
A motion to enter Executive Session to discuss pending contractual negotiations at 9:42 p.m. was made by Trustee Robert Bausch and seconded by Trustee Virginia Adams and carried by unanimous vote.

A motion was made by Trustee Robert Bausch and seconded by Trustee Anna Marie Barclay to exit Executive Session at 9:47 p.m. No votes were taken in executive session.

4) Proposal for Sewer Rate Revisions was discussed. They will continue to work on this issue.

A motion to adjourn was made by Trustee Robert Bausch and seconded by Trustee Anna Marie Barclay. The motion carried by the following vote:
