Regular Meeting Minutes
May 11, 2005


The Regular Meeting of the Board of Trustees was called to Order by Mayor Wayne Bailey at 7:00 p.m. with the following present:
Trustee Robert Bausch - aye
Trustee Anna Marie Barclay - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye

Also present were Linda Austin, DPW Supervisor Joseph Chimino, Dale Leiter, Mr. & Mrs. Smith, Gerda Cassara, Alayne Mante, and Carlton Mante.

APPROVAL OF BILLS
A motion to approve the bills was made by Trustee Anna Marie Barclay and seconded by Trustee Paul Cooper. The motion carried by the following vote:

BUDGET TRANSFERS
A motion to approve the budget transfers was made by Trustee Anna Marie Barclay and seconded by Trustee Virginia Adams. The motion carried by the following vote:

APPROVAL OF MINUTES
A motion to approve the minutes of the Regular Meeting of April 27, 2005 was made by Trustee Paul Cooper and seconded by Trustee Robert Bausch. The motion carried by the following vote:

PRIVILEGE OF THE FLOOR
Deputy Cory Mower and Sgt. Greg Walker introduced themselves to the Board and asked about their concerns.

HISTORIAN'S REPORT
Historian Tally Almquist requested the flyer for the Memorial Day program on "War Warriors" be posted in the Village.

DPW SUPERVISOR'S REPORT
DPW Supervisor Joe Chimino gave an update on the work his crew is doing. He also reviewed the electric fund for 2005-2006.

TRUSTEE CONCERNS

1. Trustee Barclay questioned if there is a contract with Stuart Brown for grant-writing.
2.

A motion to have Laura Landers audit the books due to change over of personnel was made by Trustee Virginia Adams and seconded by Trustee Anna Marie Barclay. The motion carried by the following vote:

NEW BUSINESS

1.

A resolution for a Budget Amendment was offered for adoption by Trustee Robert Bausch and seconded by Trustee Anna Marie Barclay.

WHEREAS, Boy Scout Craig Holland collected $1,600 for park benches; and

WHEREAS, the Village of Bergen Board has authorized a Budget Amendment of $1600 from 2705A Gifts and Donations to 7110.200A Park Equipment; and

NOW, THEREFORE, BE IT RESOLVED, on this 11 day of May 2005, by the Village Board of the Village of Bergen, County of Genesee, State of New York that a Budget Amendment is hereby made for $1,600.00 to come from Gifts to Park Equipment.

The resolution carried unanimously.

2.

A resolution was offered for adoption by Trustee Robert Bausch and seconded by Trustee Paul Cooper to increase the 2005 Budget to utilize vacation/paid leave reserves.

WHEREAS, The Village of Bergen, New York is a municipal corporation of the State of New York with offices at 11 Buffalo Street, Bergen, New York, 14416, and

WHEREAS, this local law is enacted consistent with the provisions of the Village Law of the State of New York as amended from time to time, and

WHEREAS, the Village has created and funded a paid leave reserve to account for unused but accrues vacation time, and

WHEREAS, Tracy P. Jong was not reappointed as of April 1, 2005, and

WHEREAS, Tracy Jong left with accrued but unused vacation and personal time with a dollar value of $2,502.11, and

WHEREAS, the employee require payment for all accrued and unused vacation and personal time, and

WHEREAS, the Village seeks to increase the budget by $2,502.11 from the General Fund Paid Leave Reserves, and increase the following appropriation account 9030.800A Social Security, 9035.800A Medicare to cover balance of May payrolls.


RESOLVED AND ORDERED BY THE BOARD OF TRUSTEES that,
1. The foregoing is in the best interests of the residents of the Village of Bergen, and
2.

IT IS HEREBY RESOLVED that the Village will increase the budget in line item 9089.820A Vacation time in the amount of $1,962.95 and increase 9089.840A Personal time in the amount of $539.16. The Clerk's Office and Village accountant are authorized and directed to execute any budget adjustments and accounting entries required on behalf of the Village of Bergen to effectuate said budget increase.

The resolution carried unanimously.

3. Gerda Cassara requested to buy the leased land behind Morgan's.


OLD BUSINESS

1. Electric budget - tabled.
2. Community Action Day update by Trustee Barclay.
3. Trustee Barclay gave a report on the grant for Main Street Revitalization.
4. A motion to award refuse bid to Heberle Disposal after reference check was made by Trustee Robert Bausch and seconded by Trustee Paul Cooper. The motion carried unanimously.


EXECUTIVE SESSION
A motion was made by Trustee Robert Bausch and seconded by Trustee Anna Marie Barclay to enter Executive Session to discuss personnel matters. The motion carried by the following vote:
Trustee Robert Bausch - aye
Trustee Anna Marie Barclay - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye

Executive Session was entered at 8:23 p.m.

A motion was made by Trustee Robert Bausch and seconded by Trustee Virginia Adams to exit Executive Session. The motion carried by the following vote:
Trustee Robert Bausch - aye
Trustee Anna Marie Barclay - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye

Executive Session was exited at 8:58 p.m.
