SPECIAL MEETING The Special Meeting of the Board of Trustees was called to Order by Mayor Wayne Bailey at 6:30 p.m. with the following present: Trustee Robert Bausch Trustee Anna Marie Barclay Trustee Virginia Adams Trustee Paul Cooper Also present was Administrator Tracy Jong.
The proposed purchase is from Rescue One located in Manasquan, New Jersey. The obligation is in the maximum principal amount not to exceed $188,926.00. The Equipment is to be used for the provision of fire protection service to the Village of Bergen, Town of Bergen and Town of Riga, pursuant to contracts, effective as of January 1, 2005. The Equipment is to be garaged at 10 Hunter Street, Bergen, New York. The public hearing and the subsequent approval by the respective Town Supervisors and the Mayor of the Village of Bergen the borrowing and issuance of the obligation are prerequisites to exemption from income taxation of the interest payable under the terms of such obligation, pursuant to Section 103, Section 147, Section 150 and related sections of, and regulations under, the Internal Revenue Code. Persons attending the public hearing will be given the opportunity to make brief oral statements in connection with the proposed financing, and written comments may be submitted to the Mayor, his representative, the Town Supervisors, or their representatives at or prior to the public hearing. The Mayor shall designate Gerald Fuerch, Chairman of the Board of Directors of the Volunteer Fire Department to cause to be published in full in the Batavia Daily News a newspaper having general circulation within in Village and Town of Bergen and designated an official newspaper in said Village and Town and post on appropriate signboards maintained by the Village and Town a notice of public hearing to be held not less than 14 days from the date of publication. The notice is to be published substantially in the following form: NOTICE OF PUBLIC HEARING The motion failed with 5 opposed and the resolution was declared denied until further information is obtained from the Fire Department. The motion will be entertained again on January 12 after more information is obtained, including clarification of the Village's financial responsibility for the debt if the Fire Department was unable to pay the debt.
