Regular Meeting Minutes
January 25, 2006
The Regular Meeting of the Board of Trustees was called
to Order Mayor Wayne Bailey at 7:00 p.m. with the following present:
Trustee Robert Bausch - aye
Trustee Anna Marie Barclay - aye
Trustee Virginia Adams - aye
Trustee Paul Cooper - aye
Also present were Linda Austin, Joe Chimino, Dale Leiter, Tom Williamson,
Holden DP Miller, Elizabeth Smith, Robert Smith, Mary Ann Price, Don Cunningham
and Barry Miller.
APPROVAL OF BILLS
A motion to approve the bills was made by Trustee Paul Cooper and seconded
by Trustee Anna Marie Barclay. The motion carried by the following vote:

BUDGET TRANSFERS
A motion to approve the budget transfers was made by Trustee Anna Marie
Barclay and seconded by Trustee Virginia Adams. The motion carried by

APPROVAL OF MINUTES
A motion to approve the minutes of the Regular Meeting of January 11,
2006 was made by Trustee Robert Bausch and seconded by Trustee Paul Cooper.
The motion carried by the following vote:

PRIVILEGE OF FLOOR
Barry Miller presented the Board with the final plans for the Town's garage
and left them for review. The following were brought up:

Barry Miller wants to purchase the piece of property next to his woodshop,
but has to confirm the owner (CSX, Dale Tucker or MCW). He will then apply
for a permit for addition to his shop.

DPW Supervisor Joe Chimino submitted an oral report as follows:

CEO/ZEO'S REPORT
Tom Williamson reported the following:

Jeff Parkman (17 N. Lake) - DPW worker almost had an
accident on his steps to read meters. Sent letters to Fire Dept, DPW
and Mayor. Steps were fixed. |

Chris Barons complained about vacant house at 22 Clinton
Street; kids entering house. Tom called County to see if it could
be boarded up. |

TRUSTEE CONCERNS
Trustee Barclay left a letter for review that she was sending to Mary
Lou Rath.
MAYOR'S REPORT
Mayor Bailey reported that negotiations for the purchase of the Tully
Building from Jerry Sheridan are pending. Final details will be reported
as they come about.
OLD BUSINESS

Mayne Estates:
Carl Schoenthal met with Craig Welch regarding the FEIS to outline
the finding statement for completion. Cost estimates provided in
the FEIS are incomplete. JR Engineering recommends installing an
equalization tank with a total cost of $250,000 not $124,500 as
reported by Avery. This estimate assumes that just an equalization
tank will be to meet future demands.
The DEC letter suggests that the required improvements will be
more than simply an equalization tank and we anticipate the true
cost of upgrade to be much higher. Items not addressed in the JR
Engineering report includes future loading that will exceed DEC
standards for design and the plant's hydraulic ability to process
larger average flow volumes.
JR Report was completed in 2003 using sewer flow data from only
one year, 2002. MRB reviewed 3-years of data from 2003-2005 and
found 2005 average flow is 0.098 MGD (94% capacity). Once the plant
reached 95%, the Village will be required by DEC regulations to
have an engineering plan to address the limited capacity.
Further plant evaluation is required and a meeting with the Mayor
and Joe Chimino will be scheduled to look at details in greater
depth.
Village will review their agreement with the Town to determine
any obligation to reserve capacity for the Town.
Density - Avery proposes 124 units on 61+/- acres. R-1 zoning
provides 103 lots. Current WWTP capacity will handle only approximate
4 new homes constructed.
