VILLAGE OF BERGEN PLANNING BOARD MEETING MINUTES

December 17, 2003

Chairperson Leiter opened the meeting at 7:32 P.M.

Planning Board meeting minutes from November 19th meeting were passed out to board members. Marion Partridge made a motion to approve the minutes as written, and Jean Stewart seconded the motion. All members were in favor.

BUDVALE PROJECT UPDATE

The Village Trustees had scoping meeting. Concerns and official letter sent to developer, requesting updated DEIS. SEQR process is moving along. RG&E (impact on development) does not see a problem, but will check pressures. Electric lines are required on design drawings, for RG&E to locate gas lines. The Planning Board has had the Engineering Drawings for approximately 3 months, and has not responded officially to the developer. Suggestion made to send letter to developer stating that the plans are incomplete. Board was shown a proposed letter written by D. Leiter/T. Jong. Everyone agreed this was the best way to address the board's concerns.

Motion was made to send a letter by Jean Stewart. Marion seconded the proposal. All members were in favor.

There was discussion about townhouses that are located off Hunt Hollow, which is off Paul Road and Chestnut Ridge Rd. in Chili, NY. They are similar to the townhouses proposed by Bud Vale. Bud Vale did not build them. Parking, road size, a homeowner's association, and sidewalks were areas brought up for discussion.

Ralph Garnish talked about a homeowner's association as was mentioned in previous meetings. If the planning board wants a homeowner's association, we can recommend such an association to the trustees for the final PUD.

Sidewalks must conform to Village Land Development Law, which state that sidewalks are to be on both sides of the street. Developer would need to request waiver if they prefer to have something different. Village would not have to conform to the developer plans.

Mr. Smith wanted to express his confidence in the Planning Board, when it came to the townhouse process. All those who attended this evening's meeting agreed.

Marian made a motion to adjourn, and Dale seconded it. All were in favor.

Meeting adjourned at 8 P.M
